  1. Under the guidance from the case of Re: C (A child) (Internal relocation) [2015] EWCA Civ 1305 the court should consider the same factors, and not distinguish between internal or external child relocation.
  2. The factors to consider in child relocation, in addition to ‘The Welfare Checklist’ include the case of Payne v Payne [2001] 1 FLR 1052 which provides a blueprint that the court can be referred to.
  3. One of the most recent cases to look at international child relocation of; Jane v Peter [2025] / Re: Simon [2025] provides the up to date position of the courts, and highlights the importance of having a ‘well thought out and child focused plan’, and so preparation and being able to provide as much detail as possible is key if seeking permission to relocate.
