Illegality can bar civil claims despite insanity findings: A claimant acquitted in criminal proceedings by reason of insanity may still be prevented from recovering damages in negligence where the losses flow from their own unlawful acts.

The Patel v Mirza policy test remains central: Courts will apply the structured public-policy analysis (purpose of the prohibition, other relevant public policies, and proportionality) when determining whether the illegality defence defeats the claim.

Limits on claims against healthcare/public authorities: Even where negligent assessment or treatment is alleged, claimants may struggle to recover losses that arise directly from serious criminal acts committed during a mental health episode.
