What six months of the Renters’ Rights Act has taught us – Grounds, Procedure, and Protecting your Advice

  • To provide practitioners with a practical understanding of Section 8 possession practice six months after implementation of the RRA
  • To equip lawyers to advise clients confidently on areas of the RRA that remain judicially undecided
  • To identify the Section 8 grounds operating smoothly in practice and those which have interpretation issues
  • To calculate notice periods correctly and avoid any irregularities in drafting Form 3A
  • Be able to distinguish Grounds 1 and 1A from Ground 1B and apply the 12-month protected period accurately.
  • Be able to assess the evidence required to establish landlord intention under mandatory grounds
  • Be able to apply a framework designed for you to advise clients on unsettled points of law, including caveat wording, review triggers, and good file note practice
  • Anticipate the impact of England’s ‘Register Your Rental Property’ Service on evidencing compliance in future possession claims
  1. How not to lose possession claims on procedure - avoiding errors in drafting Form 3A and notice period miscalculations as opposed to any dispute over which ground was used
  2. Without s21 notices all s8 grounds whether mandatory or discretionary add more to the evidential threshold courts are likely to expect as much as the legal test itself. This session covers what is known about this in November 2026.
  3. How to protect your own advice and not simply your client’s position – a framework to caveat specifically, document your reasoning trail, build in review triggers to allow you to defend your position even before Courts have ruled on the point in question.
