Service of the Claim Form is one of the Claimant’s most important responsibilities, and the rules set out how it must be carried out. However, these rules can be misinterpreted, and mistakes can have serious consequences.

This live webinar delivered by Nicky Carter, will bring you up to date with the latest decisions and principles to help ensure service is effected in accordance with the rules.

This webinar is a must-watch for anyone working within Personal Injury.

All Levels – this can be picked up throughout anyones professional career regardless of experience

  • Accurately calculate Day Zero of the service window using the physical court seal rather than document receipt dates.
  • Identify procedural options available to defendants when facing invalid or late service of a claim.
  • Apply the "one-shot" rule under CPR Part 11 to ensure all service defects are raised in a single, comprehensive application.
  1. Check the Seal, Not the Delivery Date: The strict four-month window for domestic service begins the exact day the claim form is sealed by the court, not when it arrives back at your office. Miscalculating this "Day Zero" timeline by even 24 hours means an automatic strike-out of the claim.
  2. Valid Service Controls Jurisdiction: Effective service is a mandatory pre-condition to the court's power over a dispute. If a claimant serves a claim form late or through an unauthorized method, the defendant can silently ignore it without filing an Acknowledgment of Service or initiating a CPR Part 11 challenge.
  3. Service Disputes Are a "One-Shot" Application: Defendants cannot split or fragment their procedural objections. If you actively dispute jurisdiction under CPR 11, you must raise every known service defect in your initial application; holding an irregularity back to use later at a merits hearing acts as a legal waiver of that defence
