This live webinar will look at the new Rules about transparency which have been rolled out nationwide, practically how to handle this at Court and the orders the Court might make in response.

It will also consider this next to the rules, statutes and case law about disclosure of case papers out of the proceedings: what does your client want to disclose and to whom? What can be used in other proceedings or shown to the Police?

Finally, we will go through together the new advice on covert recordings: what is it for, how to manage these in court proceedings and the steps to move through.

We will also look at practice point: what to look for and what to guard against.

  1. Transparency is now the default position;

  2. Disclosure out of proceedings of more than an order may be contempt of court or even an offence

  3. Covert recordings are now strongly discouraged and their authenticity will usually need to be tested

This is a session for a specialist family practitioner, probably more useful for private law than finance, but most of it is relevant to both.

This session will be accessible to all levels of family practitioner.

Delegates should leave with a clear idea of the new Rules about transparency, how to manage these cases and what to expect from the court. Delegates will then refresh and augment their knowledge about advising clients on what can be disclosed out of proceedings, or into other proceedings, by whom and to whom.

Finally, delegates will be left with a full understanding of the new guidance on how to manage covert recordings, made by their client, or another party or a third party, considerations on how to manage the material, whether and why to seek permission to put this into evidence and practice points on what ay or may not be useful.

    Katharine Bundell MCIArb

    Katharine is a barrister at 4 Paper Buildings who specialises in financial remedy and private law children on divorces, particularly high net worth or complex cases and those with international elements.

    She is a qualified arbitrator for finance and children. Katharine sits on the FLBA committee and is a member of the Financial Remedy Rules sub committee. She is a qualified pupil supervisor and mentor. Katharine lectures for all of the main CPD providers. She spoke at the first New York State Bar Association Global Law Symposium and Tech Summit on Crypto-currency.

    She has written for the FT, Solicitor’s Journal and other magazines and papers. Katharine has written a book on Schedule 1, Financial Provision for Unmarried Parents which has just gone into a second edition.
