Family lawyers are often the first ones to see claims about beneficial interests in property when relationships fail. However, it can also provoke anxiety as these are civil proceedings in a county court and it can feel unfamiliar.

This talk will give you the essentials you need to advise on whether such a claim may be available, or not. We will look at the fundamentals of constructive trusts, proprietary estoppel, s 37 MPPA 1970 and orders for sale. We will look at the main procedural rules you need to negotiate and give lots of practice points along the way.

This webinar is designed for regular financial remedy practitioners.

Intermediate to Advanced – Suitable for practitioners with some previous knowledge or awareness of the subject, through to those with a working knowledge and potentially extensive experience.

By the end of this webinar, delegates should gain greater confidence in:

  • Determining whether there is a case to run or not;
  • Understanding what to do when served with such a claim;
  • Identifying which rules need to be considered;
  • Knowing how to deal with costs schedules;
  • Understanding which evidence to focus upon.
  • Declarations of Trust
  • These claims are often made to counter a Schedule 1 claim or to try to steal a march on a Schedule 1 claim;
  • They are civil claims, not family court claims, and so the Rules and particularly the costs regime is quite different;
  • Making early offers and managing costs schedules are important but also knowing the basics so you can advise.
