The EU Settlement Scheme was created to provide a route for EU nationals, and their family members, to transition into immigration leave, without losing the benefits accrued as members of the European Union. The scheme formally closed to new entrants in June 2021, but remains open for who were granted pre-settled status, and to a dwindling number of those who missed the deadline for good reason. It has been repeatedly tweaked, as a result of both political and jurisprudential pressure over the years, and thus for practitioners and beneficiaries alike, it is important to know where we currently stand.

This course will cover the process for applying for stay and settlement, including:

  • What remains a good reason to apply after the deadline
  • family permits
  • the impact of automatic extensions,
  • the impact of absences during the qualifying period,
  • the expanded cancellation policy,
  • changes for primary carers,
  • and how to challenge decisions

Aimed at lawyers and charities working in the sector, this course will cover recent changes in the Immigration Rules and guidance as are relevant to the EUSS and EU free movement law.
