Many married couples (and to a lesser extent cohabitees) solve the problem of protecting assets against care home fees and second marriages by the use of flexible life interest trusts. They do an admirable job at protecting assets but the trust will have to be registered on the Trust Register and the assets held in the trust will be part of the life tenant’s IHT estate which can be expensive on the second death. This session will look at:

  • The need to check the terms of the trust.
  • The powers trustees usually have.
  • IHT issues, particularly the effect on the availability of the residence nil rate band.
