This webinar is aimed at providing practitioners with a practical guide on the support eligible to families involved in care proceedings. Imogen will explore resources that can assist a parent’s case when the matter has or is likely to come before the court.

This includes:

  • Assessments in care proceedings under section 38(6) of the Children Act and analysis of Re Y (A Child) (S.38(6) Assessment) [2018] EWCA Civ 992 and Re G (Interim Care Order: Residential Assessment) [2005] UKHL 68.
  • Costs of support including residential unit assessments and therapy.
  • Relevant courses to assist parents when the Local Authority has concerns including training programmes and addiction services. This includes practical tips on the best courses and support services to meet the family’s needs.
  • Particular support for children with disabilities and special educational needs support for children, including EHC plans.

This session will provide useful tips for any practitioner working in care proceedings, from Local Authority’s to parent’s solicitors. It will provide information on what support should be offered to families and practical tips on how what to expect from the Local Authority.

  • Time is of the essence in PLO and at the beginning of care proceedings. Engage in the question of resources and support as soon as possible.
  • Assessments must be necessary and proportionate. The court will take a child-focused approach.
  • Be prepared to think creatively about support and resources including outside the family’s locality.

    About the speaker

    Imogen Mellor

    Imogen is a specialist children barrister and court of protection barrister. She is ranked as Up and Coming at the Family Bar by Chambers and Partners (2025) and ranked by Legal 500 as a Rising Star at the Family Bar (children and domestic abuse) (2024 and 2025) and Court of Protection (Health and Welfare) (2025).

    She is praised for her approachability, practicality, client-care skills and tenacity. Imogen has acted as sole counsel in care, private children proceedings and international cases at the High Court. She has also been led on complex cases. She is highly adept at dealing with complex cases involving vulnerable clients and their needs, including those with mental health conditions and cognitive difficulties. She is currently learning British Sign Language and is developing a specialism working with Deaf clients. She is knowledgeable in her understanding of the Deaf community and culture, being able to empathise with clients and strategically advise on the best forms of support to meet their needs.

    She is a go-to counsel for care cases and cases concerning honour-based abuse and child abuse linked to faith and belief. She has been interviewed on BBC Radio London in relation to FGM and she writes and educates on the topic, including presenting at NGOs, charities, to lawyers and for other stakeholders. She accepts instructions in relation to honour-based abuse in the field of family and court of protection.

    Imogen previously taught at Goldsmiths University as a Visiting Lecturer.
