Plea Before Venue: an introduction (or refresher) and case update

Plea before venue and allocation are key areas of criminal process, and a key point at which a legal representative needs to give advice to their client; so it's useful to have an introduction, or refresher for this who have been doing other things for a while, as well as considering some recent cases and the issues which arose in them.

This presentation aims to do three things, review the process for plea before venue and allocation, consider some of the factors to consider in advice on plea and venue, and review some recent cases.

Credit has been a regular issue in recent case law, and this presentation will look at that as well as some procedural issues in the case law review.

The key legislation includes the Magistrates’ Courts Act 1980, the Crime and Disorder Act 1998, and parts 8 & 9 of the Criminal Procedure Rules. It will also touch on the Sentencing Act 2020, and the Allocation Guideline produced by the Sentencing Council.
