From the original scope when Rent Repayment Orders (RRO) were introduced in the Housing Act 2004, to the legal framework set out in the Housing and Planning Act 2016 and their expansion in 2017 this course will define what an RRO is and look at the offences that trigger liability and the associated penalties.

Delegates will receive practical guidance on First-tier Tribunal procedure, the evidential burden, common pitfalls, and areas of mitigation for Respondents to such applications.

  1. RROs now cover a lot more offences than originally intended meaning greater exposure for landlords and more opportunity for practitioners
  2. RROs sit in a unique hybrid space with the offence to be proved beyond reasonable doubt and yet the case is decided in the First-tier Tribunal, which practitioners must understand.
  3. A landlord’s “reasonable excuse” argument rarely succeeds. The case law shows that there is limited tolerance for not understanding licensing regimes, compliance delays, or an administrative oversight. Knowledge of management of residential property becomes essential to avoid the potential penalty which will double under the reform.
