Ask a Question

This bite-size round up will set out how charities approach requests to give up all, or part of an entitlement it has received under a Will.

We will begin by covering the legal and regulatory frameworks that exist and which must be followed to ensure decisions are made effectively and aligned with current guidance.

We will bring this to life using real examples, from the perspective of an in-house charity legacy manager, using a conversational and informal FAQ style. This will give an opportunity for legal practitioners to understand how they can support these, sometimes challenging, requests.

We will end by referencing some potential up-coming changes which would come into force with the completion of the implementation of Charities Act 2022.

  • Understand the level of evidence required to support a request to make an ex-gratia payment
  • Manage expectations when an ex-gratia request has been made
  • Understand the proposed changes and timescale for the implementation of sections 15 and 16 of Charities Act 2022 and the impact on the process to consider ex gratia payments.
