This is a 70 minute lecture on the topic of parental alienation. These cases are difficult and draining for practitioners. This lecture considers much of the very recent and fast changing case law in the area, identifying the ratio from various judgments and how the High Court and at times the Family Court is approaching these situations. We consider cases which have “gone wrong” , and why, and cases which have had happier endings. The lecture also looks at the approach of Cafcass, some of the basic psychology behind alienation and the definitions: what is and is not alienation. It helps you identify early on if your case may have an issue about alienation and how to avoid a case being run as one about alienation when it is not. It then looks at practical tips for case management and orders to seek, potential solutions and options for some of the more common scenarios.
