This session will look at troublesome issues in relation to planning and drafting wills, particularly when clients are trying to achieve a fair result for different beneficiaries. This may be simply different family members: children from first marriage, second spouse or civil partner; it may be charities and family members.

Avoiding misunderstandings

What does the client want to achieve?

  • Achieving a fair result
  • Legacy or share of residue?
  • Reduced rate of IHT: implications and formula clauses

Avoiding challenges

  • Look at previous wills
  • Document reasons for dispositions
  • Document your assessment of testamentary capacity
  • Suggest a medical report when appropriate
  • Consequences where a medical report is not obtained
