Schedule 1 Children Act 1989

Ask a Question

This underused schedule of the Children Act is finally coming out from the shadows as more unmarried parents need support for their children beyond the child maintenance service.

This lecture will consider the overarching statutory regime, and the seminal cases some of which are really very recent. We will also look at more modest asset cases from the family court. We will consider the strategies in play when mounting or defending such applications, and the main differences between a schedule 1 and financial remedy case.

Who this is for:

This lecture is designed for regular financial remedy practitioners.

Top 3 takeaways from the webinar:

  • These are needs cases with no sharing element;
  • The court will start with housing and this will almost always be by way of property settlement rather than transfer;
  • Lump sums are available for payment of debt, purchase or moving home and capital needs;
  • Periodical payments are only available after a maximum income assessment by the child maintenance service

CPD hours:

This webinar provides you with 1 hour of learning.

Attendees will receive a CPD certificate upon completion of this course.

Learning objectives:

Delegates should gain significant confidence in running these cases and in being able to advise on outcomes from recent case law and the statutory regime.
